If a facility is in violation of air quality requirements, the Southwest Ohio Air Quality Agency issues a Notice of Violation (NOV). NOVs are certified letters sent to companies identifying air quality rule violations and requiring the company to end the violation and/or submit a plan to resolve the violation. If a facility has been issued a NOV and the violation is substantial (serious) or compliance cannot be achieved within a short period of time, Enforcement Action Referrals (EARs) are prepared and submitted to the OEPA for final resolution. Violation of permit requirements can result in fines or additional controls.
